Xenofan Consultants Constructions inc. ("Xenofan", "we", "us") operates the website xenofan.ca. This policy explains what personal information we collect through the website, why, how we protect it, and the rights you have under Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and Québec's Act respecting the protection of personal information in the private sector (Law 25). Our ForeCost application (app.xenofan.ca) has its own privacy policy.
1. Person responsible for the protection of personal information
Under Law 25, the person responsible for the protection of personal information (our Privacy Officer) is the President of Xenofan Consultants Constructions inc. You can reach them at privacy@xenofan.ca for any question or to exercise your rights.
2. Personal information we collect
Inquiries and quote requests: your name, email address, phone number, company, and the project details you choose to share in our contact forms.
Downloads and planning notes: your work email, your role, your answer to optional questions (for example, whether you have a project planned), and whether you agreed to receive further communications.
Job applications: your contact details, résumé and the information you include, if you apply through our website. [Delete this line if applications are not received through the site.]
Website usage: pages visited, referring website, approximate location (city or region), device and browser type. This information is collected by Squarespace Analytics and, if you accept analytics cookies, by Google Analytics. These providers process your IP address to produce these statistics.
We do not intentionally collect sensitive information (for example, health, financial-account or government-ID numbers). Please do not include such information in our forms.
3. Why we use it
To answer your inquiries and prepare proposals.
To send you the documents you request, such as planning notes.
With your consent only, to send you occasional planning notes and updates about our services.
To understand how the website is used and improve it.
To consider your application, if you apply for a position.
To comply with our legal, accounting and regulatory obligations.
We do not sell your personal information.
4. Consent
By submitting a form, you consent to the collection and use of the information you provide for the purpose of that form. We send marketing emails only if you tick the consent box, which is never ticked in advance. Every email we send includes a link to unsubscribe. You may withdraw your consent at any time by unsubscribing or by writing to privacy@xenofan.ca.
5. Cookies and analytics
Our website uses cookies that are strictly necessary for it to work and stay secure. Analytics cookies (Squarespace Analytics and Google Analytics) are off by default and are used only if you accept them in the cookie banner. You can change your choice at any time through the cookie settings link at the bottom of the website, or by clearing cookies in your browser. We do not use advertising or cross-site tracking cookies.
6. Service providers and transfers outside Québec
We rely on a small number of service providers, bound by contract to protect your information and to use it only to provide services to us:
Squarespace: website hosting, forms and website statistics.
Google: Google Analytics (website statistics) and Google Drive (storage of form submissions).
[Email provider]: our business email.
These providers may store or process information outside Québec and Canada, including in the United States. As required by Law 25, we assess such transfers and put appropriate contractual and technical safeguards in place.
7. Retention and destruction
We keep personal information only as long as needed for the purposes above, or as required by law, then delete it or irreversibly anonymize it.
Inquiries and proposals: [3 years] after our last exchange; [7 years] if a mandate is signed, for our accounting records.
Download and planning-note signups: until you unsubscribe, or [2 years] without any interaction.
Website statistics: 14 months in Google Analytics, then deleted automatically.
8. Your rights
Subject to legal limits, you may:
Access the personal information we hold about you and know how it is used.
Correct inaccurate or incomplete information.
Withdraw your consent and ask us to delete your information.
Receive the computerized personal information you provided, in a structured, commonly used format (portability).
To exercise any right, write to privacy@xenofan.ca. We respond within the time limits set by law (generally 30 days).
9. Security
We use reasonable technical and organizational safeguards: encrypted connections (HTTPS), access limited to people who need it, and secure accounts with our providers. No system is perfectly secure. We maintain a process for confidentiality incidents and will notify affected individuals and the Commission d'accès à l'information of any incident presenting a risk of serious injury, as required by Law 25.
10. Children
Our website is intended for businesses and professionals and is not directed to individuals under the age of 14. We do not knowingly collect personal information from children.
11. Complaints
If you have a concern, please contact our Privacy Officer first at privacy@xenofan.ca. You may also file a complaint with the Commission d'accès à l'information du Québec (CAI) or the Office of the Privacy Commissioner of Canada (OPC).
12. Changes to this policy
We may update this policy. Changes will be posted on this page with a new "last updated" date.
